What is the purpose of the Cannabis Association?

Cannabis Associations

Cannabis associations have emerged in response to the need to strike a balance between cannabis use and legal regulations in Spain. These organisations, made up of people who share an interest in consuming cannabis safely and responsibly, seek to provide a controlled environment free from the black market. But what goals do these associations really pursue? Let's take a closer look at cannabis clubs to better understand their purpose. At Terpy, our cannabis association in the Raval, we live it every day.

What is a Cannabis Association and how does it differ from a Cannabis Social Club?

A cannabis association is a group of people who come together to grow and consume cannabis in a controlled and private environment. Unlike cannabis social clubs, which also offer a space for socialising, associations are mainly focused on risk reduction and promoting responsible use.

The main difference is that associations operate on a non-profit basis. This means their purpose is not to sell or market cannabis, but to facilitate its consumption within a private sphere, under the supervision of their members.

What is the main purpose of a cannabis association?

The main aim of a cannabis association is to create a safe and controlled space for cannabis consumption that takes place privately and in small quantities, thereby avoiding illegal trafficking and unregulated consumption.

Through these partnerships we seek to offer:

  1. An environment where members can access cannabis without turning to the black market.
  2. Protecting the right to consume marijuana in a private space, calmly and responsibly.
  3. A setting for consumption that respects local laws and avoids public exposure.

Cannabis clubs offer their members multiple benefits, including:

  • Access to quality cannabis.
  • A private, safe space to consume without worries.
  • Advice and support for responsible consumption.
  • The opportunity to be part of a community that promotes public health and wellbeing.

Why Do Cannabis Associations Operate on a Non-Profit Basis?

Cannabis associations in Spain operate on a non-profit basis because they are not businesses: they don't sell cannabis, but organise a shared cultivation among adult members. There is no national law regulating them; they operate within the case-law framework on shared consumption, which requires consumption to be limited to registered members and to the private sphere, with no distribution to third parties.

What are the requirements to become a member of a Cannabis Consumers' Association?

Becoming a member of a cannabis association involves meeting a few specific requirements:

  1. Be over 18 years of age.
  2. Presenting a valid ID document or passport and, depending on each association’s rules, having an invitation or endorsement from a member.
  3. Accepting the internal rules of the association.
  4. Respect the consumption limits set by the association.

These associations aim to ensure that access and consumption remain within the private sphere and away from minors.

Although the laws on cannabis consumption vary between autonomous communities, the age limit is generally set at 18 for membership of a cannabis club. This is done to promote responsible consumption and protect younger people.

How Do Cannabis Associations Regulate Private Cannabis Use?

Cannabis associations in Spain regulate consumption by making sure it only takes place within their private premises. This way, consumption isn’t visible to the public and consumption in unauthorised places is avoided.

In addition, these associations limit the amount of cannabis each member can collect to ensure it isn’t diverted to the black market.

What does the law say about cannabis associations?

Catalonia and the Basque Country are the pioneering autonomous communities in the development of these associations. Catalonia went as far as passing its own law, which was struck down by the Constitutional Court in 2018, and today there is no specific law regulating cultivation and consumption in private spaces; associations operate within the current framework of case law. This context has led to a boom in cannabis users' associations in these areas. Many associations are also grouped into federations that promote good practices, such as harm reduction and responsible use.

How Can Associations Help Reduce Black Market Cannabis Use?

Cannabis associations offer consumers a safe alternative to the black market, thereby reducing the risk of buying low-quality products and avoiding illegal trafficking. By providing a controlled environment, associations ensure that members consume marijuana responsibly and safely.

These associations promote public health by educating their members about the responsible use of cannabis, possible side effects and the difference between THC and CBD. If you’d like to know more about these differences, we invite you to read the article: THC and CBD: Know the Differences.

Each association sets its own limits, usually a monthly allowance per member, so that what is collected is intended solely for personal consumption. Note: there is no amount «permitted» by law; courts only use guideline amounts to distinguish personal use from trafficking.

Unlike illegal trafficking, associations do not sell or distribute cannabis to third parties. Cannabis consumption takes place in a closed and controlled way among members, with the aim of reducing risks and staying away from illegal activities.
